RESOLUTION RELATING TO USE OF CREDIT CARDS FOR PURCHASES

WHEREAS, the governing documents for Sanibel Harbour Yacht Club Condominium Association, Inc., a Florida not for profit corporation (hereinafter the “Association”), delegate the authority and responsibility to govern the operations of the Association to its Board of Directors;

WHEREAS, under Article 5, Section 1 of the Association’s Declaration of Condominium (“Declaration”), Article II of the Association’s Articles of Incorporation, and Article XIII of the Association’s Bylaws, the Board of Directors is responsible for adopting rules for the orderly operation of the Association; and

WHEREAS, the Association currently allows Unit Owners, tenants, and their guests to use credit cards to pay for both monthly assessments and on-site restaurant, beverage, and fuel charges; and

WHEREAS, the Board has received concerns over the administrative burden caused by use of credit cards for payment of monthly expenses at the Club, and pursuant to the authority recited above, wishes to take action to limit the use of credit cards for payment of monthly assessments;

WHEREAS, in order to limit unnecessary administrative costs associated with processing credit card payments for monthly assessments, it is necessary to formally establish limits on credit card use for this purpose.

NOW, THEREFORE, BE IT RESOLVED THAT the Association will discontinue acceptance of credit cards for monthly assessments effective April 1, 2016, and beginning on that date, use of credit cards for payment of Association monthly assessments shall be prohibited; and

BE IT FURTHER RESOLVED, that the Association will continue to accept credit cards as a method of payment for restaurant, beverage, fuel, and other charges at the Association; and

BE IT FURTHER RESOLVED, that the Association Manager shall cause this Resolution to be sent to all Unit Owners to make appropriate arrangements for alternative methods of payment.
